Terms of Service

Disclaimer

MAXShard (“MAXShard”), provides hosting services (the “Services”). By purchasing and using the Services, you hereby agree to be bound by these Terms of Service (the “TOS”). The TOS describes the terms and conditions of your use of the Services. If you do not agree with the terms in the TOS, you may not purchase or use the Services. MAXShard is not liable for any direct, indirect, consequential, or incidental damages arising from your use of the services.

1.1.1 Eligibility

By using the Services, you agree that you are at least thirteen years old. If you are between the ages of 13 and 18, you represent that your legal guardian has reviewed and agreed to these Terms. The Services are not intended for anyone under the age of thirteen without express parental consent.

2.1.1 Account

You are responsible for all activity that takes place on your account, regardless of whether or not such activity was authorized by you or not, including maintaining the confidentiality of your password. If you believe that your account has been compromised, you agree to inform MAXShard immediately. You understand that failing to do so may result in your access to the Services being suspended. You are responsible to use a strong password.

3.1.1 Billing, Payments and Refunds

It is your responsibility to ensure that your invoices are paid on time. You agree to pay for the Services in advance of the time period during which such Services are provided, using the payment methods provided by MAXShard. Unless otherwise provided, you agree that unless you notify MAXShard of your desire to cancel the Services, you will be invoiced and charged on an automatically recurring basis. All prices are in EURO unless otherwise stated.

3.1.2 All invoices must be paid within five (5) days of the invoice due date. Any invoice that is outstanding may result in the suspension or termination of Services. Access to the Services will not be restored until payment has been received. MAXShard will not activate new orders or activate new packages for customers who have an outstanding balance on their account.

3.1.3 If you cancel your service within 30 days of activation, you can request a refund and expect the full amount back with your previous payment method. All payments made to MAXShard will be refunded within a week depending on the payment method. After 30 days it won’t be possible to request a refund.

3.1.4 Chargebacks are prohibited unless you are within 30 days. Initiating a chargeback will result in instant suspension or termination of Services, and your account being sent to collections. 3.1.4 MAXShard reserves the right to change the pricing of its services. MAXShard will provide 30 days notice of any price changes.

4.1.1 Usage Limitations

Shared hosting space may only be used for files and content relative to the Game Server. Shared hosting space may not be used for storage (whether of media or other data), including, as offsite storage of electronic files, email or FTP hosts. MAXShard expressly reserves the right to review every shared account for excessive usage of CPU, disk space and other resources that negatively impact other users on the same server. MAXShard may suspend or terminate access to the Services, or remove content for those accounts that are found to be in violation of this section.

4.1.2 Shared servers are not limited in their bandwidth allowance, unless usage negatively impacts other users on the same server.

5.1.1 Service Termination

MAXShard reserves the right to cancel, suspend or terminate your access to the Services at any time without notice, if MAXShard believes you are in violation of the TOS, or for any reason if deemed necessary. If MAXShard cancels or terminates your access to the Services for any of these reasons, you shall not be entitled to receive a refund of any amounts paid for the Services.

5.1.2 UPON TERMINATION OF THE SERVICES FOR ANY REASON ANY DATA ASSOCIATED WITH THE SERVICES WILL BE DELETED AND MAY NOT BE RECOVERABLE. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN DATA BACKUPS.

6.1.1 Modification of Terms

MAXShard reserves the right to modify the TOS for any reason. You should familiarize yourself with the TOS on a regular basis to be familiar with the current terms. Any modifications to the TOS will become effective when posted unless otherwise provided. MAXShard will email customers about major changes to the TOS.

7.1.1 Privacy

Use of the Services is governed by our Privacy Policy, available at https://maxshard.com/privacy-policy, which is incorporated by reference. By using the Services, you also agree to MAXShard’s use of your information in accordance with the Privacy Policy.

8.1.1 General

The TOS, as well as the Privacy Policy, constitutes the entire agreement between the parties with respect to the Services. Any claim arising out of your use of the Services or the TOS shall be governed by the laws of the Netherlands. Neither you or MAXShard may assign or transfer the TOS or any of your rights or obligations hereunder, without the prior written consent of the other party. The headings herein are for convenience only and are not part of the TOS. MAXShard is not liable for any failure to fulfill it’s obligations due to causes beyond it’s reasonable control.

9.1.1 Affiliates

Affiliate balances can only be withdrawn to your MAXShard credit balance or PayPal.

9.1.2 Advertising your affiliate link on websites is allowed if the website requires registration and displays you as the author of the post.

9.1.3 Advertising your affiliate link on websites that provide coupon codes or discounts is not permitted.

9.1.4 The affiliate link provided must be used. Using another link (such as a shortened one) is not permitted.

9.1.5 We may investigate your affiliate account at any time to ensure all terms are being followed.

9.1.6 Violation of these terms may result in the removal of your affiliate balance, losing the ability to withdraw your affiliate balance, and/or closure of your account.

10.1.1 Electronic Communications

When you use MAXShard services, send messages over live chat, send emails, submit support tickets, or share your email with us, you are communicating with us electronically. You are giving consent to receive electronic communications from us via email, live chat, or tickets.
